1. Introduction
These Terms of Service ("Terms") govern access to and use of the HwaHwa applications and services for customers, suppliers, and couriers. By using HwaHwa, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use HwaHwa.
2. Eligibility & Accounts
- You must be of legal drinking age (18+ in Zimbabwe) to use alcohol delivery features.
- Accounts are created via phone number + one-time password (OTP). Keep your device secure; you are responsible for actions under your account.
- We may suspend or terminate accounts for suspected fraud, unsafe behavior, regulatory non-compliance, or violations of these Terms.
3. App License & Intellectual Property
We grant you a limited, revocable, non-transferable license to use the apps for their intended purpose. HwaHwa trademarks, logos, and content are protected by intellectual property laws. You may not copy, reverse engineer, or create derivative works without permission.
4. Orders, Pricing & Payment
- Placing an order constitutes an offer to purchase from the supplier. Acceptance occurs when the supplier confirms availability.
- Payment: Currently Cash On Delivery only. No card or wallet details are stored by HwaHwa.
- Prices, fees, and availability may change; obvious errors may be corrected and orders canceled or adjusted with notice.
- Taxes and regulatory fees (where applicable) may be included or itemized at checkout.
5. Alcohol Compliance & Age Verification
- Couriers must verify age at delivery. We may use automated ID scanning or manual inspection. Service may be refused if verification fails or safety concerns exist.
- We reserve the right to cancel orders involving suspected misuse, resale, or delivery to restricted areas.
6. Delivery, Title & Risk
- Estimated times are not guarantees. Delays may occur due to traffic, weather, inventory, or safety checks.
- Risk of loss transfers upon delivery to the address or recipient you designate and upon successful age verification.
- Couriers may refuse unsafe deliveries (e.g., intoxicated recipient, hostile environment).
7. Cancellations, Returns & Refunds
- Orders may be canceled by you before preparation/dispatch; after dispatch, cancellation may not be possible.
- If a supplier cannot fulfill an order, it may be canceled with notice to you. Since payment is Cash On Delivery, no electronic refunds apply.
- For defective or incorrect items, contact support immediately at delivery. Once accepted, alcohol sales are typically final due to tamper concerns and licensing rules.
8. Prohibited Conduct
- Fraudulent orders, identity misuse, harassment, or interference with operations.
- Reverse engineering, scraping, or automated access without consent.
- Bypassing safety checks, age verification, or location restrictions.
9. Suppliers & Couriers
- Are responsible for product quality, legal authorization to sell alcohol, and accurate listings.
- Agree to honor local laws, including licensing, pricing, and restricted sales.
- Are independent contractors responsible for legal road use, safety, and age verification at handoff.
- May decline deliveries deemed unsafe or non-compliant.
HwaHwa is a technology platform that facilitates connections; we are not the seller of alcohol. Disputes about product quality may be directed to the supplier; we’ll assist where possible.
10. Safety & Platform Protections
- We may use automated systems to detect fraud and abuse, throttle activity, and temporarily block suspicious behavior.
- We may remove content, suspend accounts, or refuse service to protect users, partners, or comply with law.
- Report safety concerns via in‑app Support or email; emergencies should be directed to local authorities.
11. Indemnification
You agree to defend, indemnify, and hold harmless HwaHwa, its affiliates, and partners from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your misuse of the services or breach of these Terms.
12. Disclaimers & Limitation of Liability
Services are provided “as is” and “as available.” We disclaim warranties to the maximum extent permitted by law. To the fullest extent permitted, our aggregate liability for any claims is limited to the greater of US$100 or the amount you paid to HwaHwa in the 12 months preceding the claim (excluding amounts paid to suppliers or couriers).
13. Suspension & Termination
We may suspend or terminate access immediately if we believe you violated these Terms, engaged in fraud, or pose safety/regulatory risk. You may stop using the services at any time.
14. Governing Law & Disputes
These Terms are governed by the laws of Zimbabwe, without regard to conflict of law principles. Courts of Harare, Zimbabwe, have exclusive jurisdiction. Nothing prevents either party from seeking urgent injunctive relief.
15. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including extreme weather, natural disasters, power or network failures, civil disturbances, or changes in law.
16. Changes to These Terms
We may update these Terms periodically. We will update the effective date and may provide in‑app notices for material changes. Continued use after changes means you accept the updated Terms.
